Is this a good thing? Probably not, and just one more tiny nudge in the direction of driving Americans towards "normalcy," or more accurately, the passive isolation that we always seek after a major conflict (WWI, post-Korea, Vietnam and Cold War) with the aftermath of WWII being a remarkable exception both in the public's attention span and in the government's sage discretion in showing our strength.
Human Rights Watch generally seems pretty fair, criticizing the third world regimes that no media bothers to cover, and not harping on the U.S. for petty things, so it's probably pretty bad that we're making their list. Even if it is for Al Qaeda suspects.
Why not bring them to the World Court? They probably won't be found innocent, and Europe will be more willing to work with us (especially prosecuting Al Qaeda members, whether it be as a victim a la Spain or out of the dislike for immigrants a la France and most of Europe for that matter).
