Being my home state, I've been following this issue. The most important part of the story is in the first sentence: "...the first to do so without being forced by the courts."
That's the way Europe has done it. That's the way it should be done. Courts do not allow, in most cases, issues to be fully fleshed out. They instead silence opposition and imply reckless activism and biased opinion, regardless of whether that is the actual case or not.
You may disagree with a legislature, but you can at least vote up or down on them in a year or two. Also, to get such a vote a whole process must occur which surely involves some consideration of what the constituents think.
At that point, if your side loses, you can either continue to push the agenda or concede, but at least knowing that democracy worked its proper course.
